These Terms & Conditions govern your use of the Eat Sleep Breathe Myo website and the booking or purchase of our services.
By using this website or purchasing or booking services, you agree to these Terms, subject to rights that cannot legally be waived.
Services
ESB Myo provides myofunctional, oral-function, breathing-related, educational, consultation, assessment, and related services within the applicable scope and qualifications of the practitioner providing the service.
An initial consultation or assessment may be required before ongoing services are recommended.
No Guarantee of Results
Results vary between individuals.
Progress may depend upon factors including the client's individual circumstances, attendance, participation, consistency with exercises, health conditions, development, and involvement of other healthcare providers.
No specific outcome is guaranteed.
Booking
Clients are responsible for providing accurate information when booking.
We reserve the right to determine whether a particular service is appropriate and whether we can legally and professionally provide the requested service.
Client Location
For virtual appointments, clients must accurately identify the province, state, territory, or country in which they will be physically located at the time of the appointment.
Services may be restricted based on the client's location, applicable professional requirements, licensing requirements, insurance coverage, or local law.
ESB Myo may cancel, modify, or decline a service when providing that service in the client's location would not be appropriate or permitted.
Payment
Prices and applicable taxes will be displayed or communicated before purchase.
Payment may be required when booking.
Online Purchases
Online bookings and purchases are subject to applicable Ontario consumer-protection requirements and any mandatory consumer rights that apply to the transaction.
Nothing in these Terms removes a consumer right that cannot legally be waived.
Virtual Services
Virtual services are also subject to our Virtual Care Policy and any separate informed consent required before services begin.
Intellectual Property
Unless otherwise indicated, materials created by ESB Myo—including written exercises, programs, graphics, educational materials, videos, worksheets, website content, and branding—remain the intellectual property of ESB Myo or their respective owners.
Materials provided to clients are for personal use and may not be reproduced, sold, distributed, published, or commercially exploited without authorization.
Website Information
Website and social-media information is educational and does not constitute an individualized assessment, diagnosis, or treatment recommendation.
Third-Party Services
We may rely upon third-party platforms for booking, payments, forms, video conferencing, or other services.
We are not responsible for interruptions or failures outside our reasonable control.
Governing Law
Subject to mandatory laws that may apply based on the circumstances, these Terms are governed by the laws of Ontario and the applicable federal laws of Canada.
